Equality and Human Rights Assessment

This assessment is prepared in accordance with Section 42 of the Irish Human Rights and Equality Commission Act 2014.

The Department of Enterprise, Trade and Employment is committed to encouraging a culture of inclusion, fairness and respect for all staff and customers of the department. We want to ensure that staff are empowered to achieve to their full potential, and that access to services, opportunities and career development is available on an equal footing to everyone.

Under the Irish Human Rights and Equality Commission Act 2014 there is an obligation on public bodies to promote equality, prevent discrimination and protect the human rights of their employees and their service users. This obligation is known as the Public Sector Duty.

To fulfil this duty, public bodies must:

  • assess the human rights and equality issues it believes are relevant to its functions
  • address these issues and describe how it plans to address these issues in its strategic plan
  • report on developments and progress in the annual report

The first step for public bodies to meet their obligations under the duty is to assess any human rights and equality issues for people who use its service and its staff. This assessment is prepared in accordance with Section 42 of the 2014 Act and considers the equality and human rights issues of relevance to the staff and service users of the department and its offices. 


Measúnú Comhionannais agus Cearta Daonna 

Ullmhaítear an Measúnú seo i gcomhréir le Acht fá Choimisiún na hÉireann um Chearta an Duine agus Comhionannas 2014. 

Tá an Roinn Fiontar, Trádála agus Fostaíochta tiomanta do chultúr cuimsithe, cothromais agus measa a spreagadh i leith gach ball foirne agus custaiméir de chuid na roinne. Ba mhaith linn a chinntiú go mbeadh gach ball foirne cumhachtaithe chun barr a gcumais a bhaint amach, agus go mbeadh rochtain ar sheirbhísí, ar dheiseanna agus ar fhorbairt gairme ar fáil ar chomhchéim do chách.

Faoin Acht fá Choimisiún na hÉireann um Chearta an Duine agus Comhionannas 2014 tá oibleagáid ar chomhlachtaí poiblí comhionannas a chur chun cinn, leithcheal a chosc agus cearta daonna a mball foirne agus a n-úsáideoirí seirbhíse a chosaint. Tugtar Dualgas na hEarnála Poiblí ar an oibleagáid seo.

Chun an dualgas seo a chomhlíonadh, ní mór do chomhlachtaí poiblí:

  • measúnú a dhéanamh ar na ceisteanna cearta daonna agus comhionannais a gcreideann siad go bhfuil baint acu lena bhfeidhmeanna
  • aghaidh a thabhairt ar na ceisteanna sin agus cur síos a thabhairt faoin gcaoi atá beartaithe acu dul i ngleic leis na ceisteanna sin ina bplean straitéiseach
  • tuairisc a dhéanamh ar fhorbairtí agus ar dhul chun cinn sa tuarascáil bhliantúil

Is í an chéad chéim do chomhlachtaí poiblí lena n-oibleagáidí a chomhlíonadh faoin dualgas measúnú a dhéanamh ar aon cheisteanna cearta daonna agus comhionannais do dhaoine a mbaineann úsáid as a seirbhís agus dá mball foirne. Ullmhaítear an measúnú seo i gcomhréir le hAlt 42 den Acht 2014 agus cuirtear na ceisteanna comhionannais agus cearta daonna a bhfuil baint acu le baill foirne agus le húsáideoirí seirbhíse na roinne agus a hoifigí san áireamh leis.
