EU Copyright Reform

On 14 September 2016, the European Commission launched a series of legislative proposals aimed at modernising copyright, including a proposed Directive on Copyright in the Digital Single Market. These proposals follow from the December 2015 communication on copyright entitled 'Towards a modern, more European copyright framework' that set out the vision of the Commission to create a modern EU copyright framework fit for the digital age.

Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market

The EU Directive on Copyright in the Digital Single Market was negotiated and agreed under the Digital Single Market strategy between September 2016 and May 2019. The intention of the Directive is to craft a modern copyright legislation to respond to the needs of all European citizens in an increasingly digitalised society. The Directive was published in the Official Journal of the European Union on 17 May 2019 and Ireland, along with all other EU Member States, has until 7 June 2021 to transpose it into national legislation.

This Directive allows for wider access to and use of copyright protected works benefitting the creative sectors, press publishers, researchers, educators, cultural heritage institutions, and citizens. It provides a framework for the creation of modern European copyright legislation to take account of technological developments in the digital age while continuing to ensure that creators are remunerated for their creative efforts.

Following the publication of the Directive, the Department carried out a series of public consultations seeking the views of all interested stakeholders on the transposition of the Directive into Irish law.

A draft Statutory Instrument is with the OPC for formal drafting and the Department is working towards the transposition of the Directive by the deadline of 7 June 2021.
