The Personal Injuries Resolution Board Bill 2022 amends the Personal Injuries Assessment Board Act 2003-2019 to facilitate an increase in the number of personal injury claims that may be resolved through the Board’s process and without recourse to litigation.
The Bill provides for a new function for the Board – mediation, and for amendments to the discretionary powers provided to the Board as set out in section 17 of the Principal Act and amendments to section 51A of the Act regarding costs in proceedings.
The Bill also provides for the renaming of the Board as the Personal Injuries Resolution Board (PIRB) and contains several amendments to the Act to enhance the role of the Board regarding promotion of the work of the Board; data analysis and reporting functions; and measures to help the prevent fraud.
