Code of Practice on the Right to Request Remote Working

The Workplace Relations Commission (WRC) has been directed under Section 20(2) of the Workplace Relations Act 2015, to prepare a Code of Practice on the ‘Right to Request Remote Working’ as required under Part 4 of the Work Life Balance and Miscellaneous Provisions Act 2023.

In this context the WRC is undertaking a public consultation with a view to drafting a Code of Practice on the Right to Request Remote Working. The Code, inter alia, will set out practical guidance for employers and employees as to the steps that may be taken for complying with the requirements of the Act in relation to applications for flexible or remote working.

In this regard, the WRC invites submissions on this matter to be submitted to the WRC by 5pm on 9 June 2023.

Submissions marked ‘Right to Request Remote Work’ should be sent to RTRRW@workplacerelations.ie or by post to Workplace Relations Commission, Lansdowne House, Lansdowne Road, Dublin 4, D04A3A8.

As part of the consultation process, the WRC may consult with parties to clarify submissions received or with certain key stakeholders.

Freedom of Information and Data Protection 

Freedom of Information Act 2014 and publication of submissions

The Workplace Relations Commission (WRC) may publish on its website all submissions received under this consultation. Your attention is also drawn to the fact that information provided by you in submissions is subject to release by the WRC under the Freedom of Information Act 2014. In responding to this public consultation, all individuals and organisations should clearly indicate where their submission contains personal information, commercially sensitive information and/or confidential information which they would not wish to be made publicly available by being published on the WRC’s website or released by the WRC pursuant to the receipt of an FOI Request under the Freedom of Information Act 2014. It is also important to note that your name and address and other details such as your representative organisation or any other information that you provide in your submission will be published on the WRC’s website unless you specifically request that such details are redacted or removed. 

General Data Protection Regulation (GDPR) and Data Protection Acts 1988 to 2018

The Workplace Relations Commission (WRC) is subject to the provisions of the GDPR and Data Protection Acts 1988 to 2018. In this context, the WRC will treat all personal information which you provide in submissions as part of this public consultation process with the highest standards of security in line with our data protection compliance requirements.

Tá treoir tugtha don Choimisiún um Chaidreamh san Áit Oibre (WRC) faoi  Alt 20(2) den Acht um Chaidreamh san Áit Oibre 2015, Cód Cleachtais a ullmhú um an 'Ceart Cianobair a Iarraidh' mar a cheanglaítear faoi Chuid 4 den Acht um Chothromaíocht Oibre is Saoil agus Forálacha Ilghnéitheacha, 2023.

Sa chomhthéacs sin, tá an WRC ag tabhairt faoi chomhairliúchán poiblí d'fhonn Cód Cleachtais a dhréachtú maidir leis an Ceart Cianobair a Iarraidh. Leagfar amach  sa Chód, inter alia, treoir phraiticiúil d'fhostóirí agus d'fhostaithe maidir leis na céimeanna a d'fhéadfaí a ghlacadh chun ceanglais an Achta a chomhlíonadh i ndáil le hiarratais i gcomhair obair sholúbtha nó cianobair.  

I ndáil leis sin, iarrann an Coimisiún aighneachtaí maidir leis an ábhar seo a chur faoi bhráid an Choimisiúin faoin 5pm an 9 Meitheamh 2023.

Ba chóir aighneachtaí a bhíonn marcáilte 'An Ceart Cianobair a Iarraidh' a sheoladh chuig RTRRW@workplacerelations.ie nó tríd an bpost chuig an gCoimisiún um Chaidreamh san Áit Oibre, Teach Lansdún, Bóthar Lansdún, Baile Átha Cliath 4, D04A3A8.

Mar chuid den phróiseas comhairliúcháin, féadfaidh an Coimisiún dul i gcomhairle le páirtithe nó le príomhpháirtithe leasmhara áirithe chun aighneachtaí a fuarthas a shoiléiriú.

Saoráil Faisnéise agus Cosaint Sonraí

An tAcht um Shaoráil Faisnéise 2014 agus Aighneachtaí a Fhoilsiú

Féadfaidh an Coimisiún um Chaidreamh san Áit Oibre (CCÁO) gach aighneacht a fhaightear faoin gcomhairliúchán seo a fhoilsiú ar a shuíomh Gréasáin. Dírítear d’aird freisin go bhfuil faisnéis a chuireann tú ar fáil in aighneachtaí faoi réir a scaoileadh ag an WRC faoin Acht um Shaoráil Faisnéise 2014. Agus freagra á tabhairt ar an gcomhairliúchán poiblí seo, ba cheart do gach duine aonair agus eagraíocht a léiriú go soiléir an áit a bhfuil faisnéis phearsanta ina n-aighneacht. , faisnéis atá íogair ó thaobh na tráchtála de agus/nó faisnéis rúnda nár mhaith leo go gcuirfí ar fáil go poiblí í trína bhfoilsiú ar shuíomh Gréasáin an WRC nó í a scaoileadh ag an WRC de bhun Iarratas um Shaoráil Faisnéise a fháil faoin Acht um Shaoráil Faisnéise 2014. Is tábhachtach a thabhairt faoi deara go bhfoilseofar d’ainm agus do sheoladh agus sonraí eile ar nós d’eagraíocht ionadaíoch nó aon fhaisnéis eile a chuireann tú ar fáil i d’aighneacht ar shuíomh Gréasáin an WRC mura n-iarrann tú go sonrach go ndéanfaí na sonraí sin a athrú nó a bhaint.

An Rialachán Ginearálta um Chosaint Sonraí (RGCS) agus na hAchtanna um Chosaint Sonraí 1988 go 2018

Tá an Coimisiún um Chaidreamh san Áit Oibre (CCÁO) faoi réir fhorálacha an RGCS agus na nAchtanna um Chosaint Sonraí 1988 go 2018. Is sa chomhthéacs seo a láimhseálfaidh an Coimisiún gach faisnéis phearsanta a sholáthraíonn tú in aighneachtaí mar chuid den phróiseas comhairliúcháin poiblí seo leis na caighdeáin is airde slándála de réir ár gceanglas comhlíonta um chosaint sonraí. 

Chun tuilleadh faisnéise a fháil is féidir leat Ráiteas Cosanta Sonraí an CCÁO atá ar fáil ar shuíomh Gréasáin an CCÁO a léamh agus a mhíníonn an dóigh agus an uair a mbailíonn an Coimisiún sonraí pearsanta, an fáth a ndéanann an Coimisiún amhlaidh agus an dóigh a ndéileálann an Coimisiún leis an bhfaisnéis seo. Míníonn sé freisin do chearta maidir le bailiú do chuid faisnéise pearsanta agus an dóigh ar féidir leat do chearta a fheidhmiú faoi dhlíthe cosanta sonraí.
