Employment permit holders who are made redundant

Holders of Critical Skills or General Employment Permits

Holders of such employment permits must notify the Employment Permits Section of the Department of Enterprise, Trade and Employment within 4 weeks of the redundancy on the prescribed Redundancy Notification Form and you have up to 6 months from the date on which you were made redundant to find another job.

If you find another job and provided you have submitted the prescribed Redundancy Notification Form within 4 weeks of your redundancy date, you will be exempted from certain rules that would otherwise apply, that is, Labour Market Needs Test, and eligibility criteria in relation to the job. If you have been made redundant from an occupation that is subsequently ineligible for the type of permit that you held, because it has been added to the Ineligible List of Occupations for Employment Permits List or it has been removed from the Critical Skills Occupations List and if you are offered the same job by a different employer, then an employment permit application will be considered for the same employment permit type.

If you cannot find another job within six months of being made redundant you should contact the Immigration Service Delivery (ISD) to establish your immigration status beyond that period. Should you opt to leave the country, and you are later successful in getting another job offer in Ireland, you may apply for a new employment permit if you are eligible at that time.

Holders of Dependant/Partner/Spouse, Reactivation and Sport and Cultural Employment Permits

If you are made redundant while you are an employment permit holder, you should notify the Employment Permits Section of the Department of Enterprise, Trade and Employment of the redundancy and you have up to 6 months from the date on which you were made redundant to find another job and apply for an employment permit subject to normal conditions and criteria.

If you cannot find another job within 6 months of being made redundant you should contact Immigration Service Delivery (ISD) to establish your immigration status beyond that period. Should you opt to leave the country, and you are later successful in getting another job offer in Ireland, you may apply for a new employment permit if you are eligible at that time.
